Aspire Mountain Academy (AMA) is a division of Aspire Mountain Media. This page describes the terms of service between Aspire Mountain Media, referred to hereafter as "the Company" and those who purchase products and/or services from the Company, referred to hereafter as "Customer."
Prospective Customers may purchase access to the materials for an online course by visiting https://aspiremountainacademy.thinkific.com/. Although the online site advertises online course, the Company does not sell courses or materials for courses. The Company sells access to online course materials through a monthly subscription. Accordingly, once a Customer purchases a subscription, that Customer agrees to comply with the terms of service described below, which have been in effect since January 1, 2023. Customers who purchased a subscription before January 1, 2023, agree to the following terms of service when they pay any monthly subscription charge posted to their account after January 1, 2023. The Company may change these terms of service at any time and for any reason but will update this page with any said changes if and when they occur. Customers agree to accept these changes when they continue a monthly subscription. Customers who do not agree with any of these terms of service should cancel their subscription and delete their account.
The Company provides access to course materials through a monthly subscription managed by third-party providers. When Customers purchase access, they do so by establishing an account with the third-party provider, providing payment information to that third-party provider, and enrolling in a monthly subscription. By enrolling in a subscription, Customers indicate agreement to these terms of service. Customers may use their purchased access whenever and wherever they have access to the Internet so long as they have not cancelled their subscription. Once a Customer cancels a subscription, that Customer loses access to the respective course materials.
Customers agree to pay all monthly subscription charges until they cancel their subscription. Furthermore, Customers agree that their use or non-use of access to course materials does not entitle them to any refund. By failing to cancel a subscription in accordance with these terms of service, which Customers may do at any time for any reason, Customers agree to pay any disputed monthly subscription charges.
Return Policy
Because Customers cannot return online access to course materials, the Company offers no returns. Furthermore, Customers agree to accept all course materials they access in the condition in which they find them.
Cancellation Policy
All Customers can cancel their subscription at any time and for any reason. The Customer is not required to provide any indication to the Company of the impeding cancellation, nor is the Customer required to provide any information to the Company regarding the cancellation following the cancellation. To cancel a subscription, a Customer must log into the third-party-provider account used to initiate the subscription. Due to the high volume of subscriptions and the difficulty in accessing and navigating third-party-provider systems, The Company is not able to cancel subscriptions for any individual Customer. Any Customers who desire to cancel a subscription must do so themselves by logging into the third-party-provider account created when the subscription was initiated.
A subscription begins on the day a Customer purchases a subscription. On that same day in the following month (the monthly anniversary date) , an uncancelled subscription will be automatically renewed and a payment transacted using the payment information provided by the Customer. Customers who cancel their subscription before the monthly anniversary date will not see a charge to their account on the monthly anniversary date of the following month but but will lose access to course materials on the day the subscription is cancelled. On the other hand, customers who do not cancel their subscription before the monthly anniversary date will see a charge and, because they did not cancel their subscription before the monthly anniversary date, they agree to pay that charge.
As an example, Harry decides to purchase a subscription on April 19. He provides credit card payment information when establishing his account on April 20. Thus, the 20th is Harry's monthly anniversary date, and each month on the 20th, Harry is charged the monthly subscription price in effect on April 20. Then, Harry decides on October 12 to cancel his subscription. He logs into his account on October 12 and cancels his subscription. Harry loses his access to course materials on the 12th because that is when his subscription was cancelled, and he will not see a charge on October 20 or any month thereafter unless he purchases a new subscription. In that case, he will have a monthly anniversary date on the day he purchases the new subscription.
Because not all months have the same number of days, the last day of the month will be used in lieu of those months which have fewer days. Thus, a Customer with a monthly anniversary date of the 31st will be charged on the last day of February, April, June, September, and November (until the subscription is cancelled) because these months do not have a 31st day.
Refund and Dispute Policy
All sales are final. Accordingly, the Company does not offer any refunds. Typically, customers seeking a refund want to be compensated for not using course materials. However, the Company does not sell course materials; rather, the Company sells access to course materials. So long as Customers retain something valuable from the Company in the form of access to course materials (which they do when they have an active subscription), the Company will continue to charge Customer accounts in exchange. Once Customers cancel their subscription, they lose access, and in exchange the Company ceases to charge their account.
In addition, no partial monthly subscription charge refunds are provided for Customers who cancel their subscription before their monthly anniversary date. In the example provided in the previous section on Cancellation, Harry cancels his subscription on October 12, 8 days before his monthly anniversary date on the 20th. Harry does not receive a refund for any of those 8 days; the monthly subscription charge is a one-time charge for the entire month. However, access to course materials is contingent upon having a subscription. Because Harry canceled his subscription on the 12th, he lost access to course materials on the 12th and will not be able to access course materials even though he paid for access through the 20th. Because all sales are final, Harry cannot obtain a refund for the 8 days between his cancellation date and his monthly anniversary date.
Transaction Currency
All sales transactions are made in US dollars.
Security capabilities and policy for transmission of payment card details
The Company employs third-party providers (as of January 1, 2023, Thinkific and Stripe) to facilitate payment card transactions. Customers who have concerns regarding the security capabilities and data transmission of payment card information should contact those providers.
Consumer data privacy policy
The Company does not store or sell any information which Customers provide. Third-party providers employed by the Company (as of January 1, 2023, Thinkific and Stripe) maintain that information. Accordingly, Customers with concerns about consumer data privacy should contact those providers.
